These Terms of Service ("Terms") govern your access to and use of the mobile games, applications, websites, and related services (collectively, the "Services") published by Agentic Game Design ("we," "us," or "our"), including all games distributed through the Apple App Store, Google Play Store, and other platforms, and the website agd9a.com (also reachable at agenticgamedesign.com). By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use our games and apps on devices you own or control, for your personal, non-commercial entertainment. This license is subject to these Terms and any rules imposed by the platform (such as Apple or Google) through which you obtained the app.

Our games may offer virtual currency, items, or other content for purchase or as rewards ("Virtual Items"). Virtual Items are licensed to you, not sold; you receive a limited, revocable license to use them within the applicable game. Virtual Items have no real-world monetary value, are non-refundable except as required by law or platform policy, and cannot be exchanged for cash or transferred outside the game. All purchases are processed by the platform provider (e.g., Apple or Google), and their payment terms apply. We may modify, manage, or discontinue Virtual Items at any time.
Some Services may allow you to create or share content, such as usernames, profiles, or in-game creations ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, royalty-free, non-exclusive license to use, host, display, and distribute it in connection with operating and promoting the Services. You are responsible for your User Content, and it must not infringe the rights of others or violate these Terms.
The Services, including all games, software, artwork, characters, music, text, and trademarks (including "Agentic Game Design"), are owned by or licensed to Agentic Game Design and are protected by copyright, trademark, and other intellectual-property laws. Except for the limited license granted in these Terms, no rights are transferred to you.
We may update, modify, suspend, or discontinue any part of the Services at any time, with or without notice. We do not guarantee that the Services, or any content, feature, or Virtual Item within them, will be available at all times or at any particular time, or that saved progress will be retained.
We may suspend or terminate your access to the Services at any time if you violate these Terms, if required by law, or if we discontinue the Services. Upon termination, your license to use the Services and any Virtual Items ends immediately. You may stop using the Services at any time by deleting the apps from your devices.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTIC GAME DESIGN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS (US $50). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
You agree to indemnify and hold harmless Agentic Game Design from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services.
Your use of our apps obtained through the Apple App Store or Google Play Store is also subject to those platforms' terms. Apple and Google are not parties to these Terms and are not responsible for the Services or for providing support for them. The Services may contain links to or integrations with third-party services; we are not responsible for third-party content or practices.
We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms at agd9a.com. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the state in which Agentic Game Design is organized, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Services will be resolved in the courts located in that state, unless applicable law requires otherwise. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your place of residence.
